May the Best Cock Win

The other day I was appointed to represent Juan (pictured above), who is accused of violating Penal Code section 597c(a) by being "wilfully and unlawfully present during an exhibition of an animal fight, specifically the fighting of gamecocks."

Fortunately for Juan, but not the local gamecock population, it is not a crime in California to merely be present at the scene of a crime during its commission, so the charge is demurrable as unconstitutionally overbroad.
